PAIA Manual

Prepared in accordance with Section 51 of the Promotion of Access to Information Act, No. 2 of 2000.

This manual is intended to assist potential requesters in requesting access to information (documents or records) from Christo Lochenberg Developments as contemplated under the Act.

2. The Act

The Promotion of Access to Information Act grants a requester access to records of a private body if the record is required for the exercise or protection of any rights. If a public body lodges a request, the public body must be acting in the public interest.

Requests in terms of the Act shall be made in accordance with the prescribed procedures and at the rates provided.

3. Applicable Legislation

Records are available in accordance with the following legislation (where applicable):

  • Companies Act No. 71 of 2008
  • Value Added Tax Act No. 89 of 1991
  • Income Tax Act No. 58 of 1962
  • Electronic Communications and Transactions Act
  • Protection of Personal Information Act (POPIA)
  • Consumer Protection Act No. 68 of 2008

4. Schedule of Records

Public Records: Product information, Public Website content, Price Lists.
Private Records (Request Required):

  • Financial: Annual Financial Statements, Tax Returns, Accounting Records, Banking Records, Invoices.
  • Personnel: Employment Contracts, Payroll Records, Disciplinary Records.
  • Client: Client Databases, Correspondence with Clients, Contracts, Project Specifications.

5. Request Procedure

To request access to a record, please comply with the following:

  1. Use the prescribed Form 2 (Request for Access to Record).
  2. Address the request to the Information Officer at the email address provided above.
  3. Provide sufficient detail to enable the Company to identify the record(s) requested and the requester.
  4. Indicate which form of access is required.
  5. Identify the right that the requester is seeking to exercise or protect.
  6. Pay the prescribed request fee (if applicable).

6. Grounds for Refusal

The Company may refuse a request for information if it involves:

  • Mandatory protection of the privacy of a third party (natural person).
  • Mandatory protection of the commercial information of a third party.
  • Mandatory protection of confidential information of third parties if it is protected in terms of an agreement.
  • Safety of individuals and protection of property.
  • Mandatory protection of records which would be regarded as privileged in legal proceedings.
