These terms apply to all custom software development, web application, and mobile application projects undertaken by Christo Lochenberg Developments.
1. Scope of Work
The specific deliverables, timelines, and costs are detailed in the official Project Quote or Proposal provided to you. Any features or requirements not explicitly listed in the Project Quote are considered "Out of Scope".
2. Change Control
If you wish to change the scope of the project (e.g., add new features) after work has commenced:
- A "Change Request" must be submitted in writing.
- We will provide a quote for the additional time and cost.
- Work on the changes will only begin once the quote is approved.
3. Financial Application Disclaimer
While we strive for mathematical accuracy, we are software engineers, not financial advisors or auditors. We do not provide financial advice.
You are solely responsible for:
- Verifying all financial calculations, formulas, and outputs during the testing phase.
- Ensuring the application complies with relevant financial laws (e.g., NCA, FICA, VAT Act).
- We accept no liability for financial losses resulting from calculation errors or logic flaws.
4. Payment Schedule
Unless otherwise agreed in writing, standard payment terms for development are:
- 50% Deposit: Required before work commences (Non-refundable).
- 30% Beta Release: Due upon delivery of the first testable version.
- 20% Final Sign-off: Due upon completion, before the system is deployed to the live environment.
5. Intellectual Property (IP)
- Client Ownership: Upon receipt of full and final payment, ownership of the custom code, designs, and database schemas created specifically for your project is transferred to you.
- Developer Rights: We retain the right to reuse general code libraries, architectural patterns, and knowledge gained during the project for other clients, provided no confidential data or specific business logic is disclosed.
6. User Acceptance Testing (UAT)
Upon delivery of the project, you will have a 14-day UAT period to test the software. During this time, any bugs reported will be fixed at no extra cost. If no issues are reported within 14 days, the project is deemed "Accepted".
7. Warranty
We provide a 30-Day Bug Fix Warranty starting from the date of deployment. This covers errors in logic or code that cause the software to fail.
Exclusions: The warranty does not cover:
- Issues caused by changes made by you or third parties to the code.
- Issues caused by updates to third-party APIs, hosting environments, or browsers after deployment.
- Feature requests or design changes (these are billed separately).
8. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising out of the project shall not exceed the total amount paid by the Client for the specific project deliverable.
